Icahn’s In-depth Letter to Apple Still Does Not Remove Time Horizon

We believe Apple’s (AAPL) shares have valuation upside (see 16 page report), but as we have outlined before here, activist investor Carl Icahn’s proposal to force Apple to buy back stock over a certain time period (“during fiscal 2014”) as opposed to under a certain price (our fair value estimate) is imprudent. We encourage Icahn to further revise his proposal. Additionally, we think Icahn’s valuation process is too simplistic (see footnote 1), and we encourage him to disclose a more rigorous valuation assessment of the firm that takes long-term forecasts into consideration. The summer months have been relatively uneventful, with the exception of concerns relating to the Federal Reserve’s coming tapering of its bond-buying program and quibbles between hedge fund giants over a company that makes protein shakes—we’re talking about Herbalife (HLF) in the latter example. Even the sequester proved to be a largely underwhelming event so far through 2013. As a result, the market has focused on fundamentals, awarding strong performance and punishing poor performance (almost irrespective of valuation parameters). Since sparring on CNBC last month, hedge-fund legends Carl Icahn and Bill Ackman have stolen headlines, and the battle has moved on to Herbalife (HLF). With claims of a Ponzi scheme on one side of the battle countered by claims on the other side of selling the American dream and enabling entrepreneurs, the battle between Ackman and Icahn has resulted in a wild ride in shares of Herbalife.
